I have conflicting feelings over this. I know that open carry is a thing in Texas, but who crossed the line, if anyone?

CJ Grisham, President of Open Carry Texas, Army veteran and recent candidate for State Representative in District 55, along with a couple of other people was arrested yesterday in Olmos Park, TX (Bexar County). He was tazed and subsequently injured in that arrest with a head injury and was hospitalized. I was told that the head injury was a large gash on the back of the head. He also suffered numerous scrapes on his wrists and arms.
Grisham and crew were legally opening carrying pistols and long guns in response to an event last week when an Olmos Park police officer drew guns on and detained someone with a protest sign solely for the reason of open carrying a pistol (which turned out to be a training fake).
Grisham had a phone conversation with the Olmos Park Police Chief, Rene Valenciano about their policies, etc. in which the chief seemed entirely unconcerned with his officers illegally detaining people for a perfectly legal activity. (The conversation will be linked in the comments below).
Grisham and crew went to Olmos Park yesterday and were legally and peacefully open carrying and got arrested for it. There is a video of the arrest. There was no articulated probable cause for the arrest. The police showed up, including Chief Valenciano and ordered Grisham and his crew to the ground. Grisham at least refused. It was Valenciano that personally tazed and arrested Grisham.
Between the phone call and video from the site, it's very clear this was an illegal arrest by an oath breaking police officer and they will be held accountable.

Let me make this clear up front, I don't do it, but I've got nothing against OC. If that's your thing, by all means, rock on. That said, going out in public with a holstered handgun is one thing, a loaded AR or shotgun on a tactical sling will get you unwanted attention, legal or not. A few years back, there were a couple guys here in Michigan who decided their OC right included walking into a police station with slung AR's. Guess what happened next. Don't know about anywhere else, but around here, it seems the OC advocates all have a confrontational chip on their collective shoulders. Doesn't help their cause IMHO.

That police chief needs to be fired and prosecuted. Grisham has a great lawsuit on his hands.

Texas is not a Constitutional Carry State. So if you decide to run around in Texas carrying a pistol expect an interaction with LE.

It depends if you think normal people who need to carry guns to make up for their inadequacies are NORMAL. I DON'T!

I for one am a staunch Pro 2A conservative. However in ANY situation where a police officer gives a command whether he is lawful or not should be obeyed IMMEDIATLY. That is the law. Then you take it to court. I can not ever condone anyone disobeying a lawful order by ANY police officer for ANY reason. That is paramount to anarchy and lawlessness. I know many will disagree with me but that is the difference between thugs and law abiding citizens. We do not take the law into our own hands even if we feel we are right or not doing anything wrong.

How about comply with the officer’s instructions, then sue them for false arrest? Arguing with a cop when one or both are armed usually results in someone getting hurt. They should Argue point in court, not on YouTube.

It is simply stupid to show people that you are carrying a weapon. I am a survivor of the Viet Nam conflict with 185 combat missions, I am all but tempted to hurt anyone with a weapon, sorry my training still lasts. I was trained on how to take weapons away from those that had them.

Carry laws are racist. If you research the law, it was enacted to prohibit freed slaves from owning firearms. The intent was to allow these people to be terrorized without repercussion or the means to protect their family or property. That’s why I feel carry laws should be abolished and background checks get more difficult for all.

Like Texas, Pennsylvania is an "Open Carry State." We still need a "Protection Permit" for concealed carry, and I've had one since 1979. It's common here for groups of 2nd Amendment minded people to go as a group and open carry in shopping malls, WalMart, etc. I agree with them that it's their RIGHT, and the only problem I have is, "WHY give up a tactical advantage?" After all, if you open carry and happen to walk in on a robber, you could very well become an immediate target; instead of a witness. Likewise with those who like to wear police ballcaps, or T-shirts. When a criminal would see, "whatever police," on a hat or logo, that could end badly for the wearer.
As for the Texas incident - that's not the first PD to react so poorly. There are several YouTube videos of open carry advocates being arrested, illegally - especially those carrying long guns of any type.
I suspect that police chief will ultimately end up the target of an expensive lawsuit, as he should.
Nevertheless, open carry - to me - is just asking for trouble even though in open carry states, it is a RIGHT.
