I was promoted to SGT on the first, however, i made the HRC list last march. The reason i didnt puck up was because according to my unit, i failed tape. In may of last year, the flag was lifted because it was wrong. The reg says that if the SM would have been promoted during the flag, that they will be promoted with the date of rank of when they made the list. My question is, to change my date of rank to last year, do i need to do a 4187 or is it a different process? Any advice helps. Thank you.

Get with your S1 for assistance. I was due to be promoted to SGT but got flagged, I was flagged for 90 days and then the flag was lifted. I requested my date of rank be adjusted to the original day I was supposed to be promoted. Once that was complete I requested back pay for the 90 days. It was all done through a 4187 and supporting documents. Everything went before a board of corrections, the date of rank was easy but it took about six months to receive the back pay.

Don't ask why I was flagged let's just say I wasn't a very nice person back then. Good luck!

First of all, what kind of tape test did you fail? I only ask because looking at your pic you don't fit into the category of weigh and tape, then again pictures can be deceiving. Second, how has it taken this long to be pinned after making cutoff last year; soldiers these days tend to get relieved after six months non-compliance with the flag and bar to reenlist counseling. Third, if you were flagged the list is irrelevant, you should've not made it unless the flag was posted after the HRC cutoff, even so a flag automatically disqualifies you. Back pay is easy as long as regulations allow, I see you may of read up on AR 600-8-19, however did you read the DoD FMR Vol 7A which covers military pay? To my understanding back pay will only be granted to the official date on your promotion orders and not the HRC list; this is due to multiple variables however backup documentation such as flags can effect the DOR. ~ 36B finance & accounting

I've already explained this answer, if that's what the orders say it will be hard to argue. When was your flag lifted?

Wow, if I were you I would seek legal advice. It sounds to me like a leadership failure or bias. I haven't read up on the promotion reg however I am familiar with the pay regs.
