I was promoted to SGT on the first, however, i made the HRC list last march. The reason i didnt puck up was because according to my unit, i failed tape. In may of last year, the flag was lifted because it was wrong. The reg says that if the SM would have been promoted during the flag, that they will be promoted with the date of rank of when they made the list. My question is, to change my date of rank to last year, do i need to do a 4187 or is it a different process? Any advice helps. Thank you.

Get with your S1 for assistance. I was due to be promoted to SGT but got flagged, I was flagged for 90 days and then the flag was lifted. I requested my date of rank be adjusted to the original day I was supposed to be promoted. Once that was complete I requested back pay for the 90 days. It was all done through a 4187 and supporting documents. Everything went before a board of corrections, the date of rank was easy but it took about six months to receive the back pay.

Don't ask why I was flagged let's just say I wasn't a very nice person back then. Good luck!

First of all, what kind of tape test did you fail? I only ask because looking at your pic you don't fit into the category of weigh and tape, then again pictures can be deceiving. Second, how has it taken this long to be pinned after making cutoff last year; soldiers these days tend to get relieved after six months non-compliance with the flag and bar to reenlist counseling. Third, if you were flagged the list is irrelevant, you should've not made it unless the flag was posted after the HRC cutoff, even so a flag automatically disqualifies you. Back pay is easy as long as regulations allow, I see you may of read up on AR 600-8-19, however did you read the DoD FMR Vol 7A which covers military pay? To my understanding back pay will only be granted to the official date on your promotion orders and not the HRC list; this is due to multiple variables however backup documentation such as flags can effect the DOR. ~ 36B finance & accounting

Wow, if I were you I would seek legal advice. It sounds to me like a leadership failure or bias. I haven't read up on the promotion reg however I am familiar with the pay regs.

If I'm reading this correctly you mad the list for March of 2015, but was flagged because of tape. The flag was mistake and was removed two months after the fact but you were not pinned until 01 FEB 2016. Is that correct?

I got promoted in Afghanistan and my pay was messed up to. All you need from S1 is your promotion orders, rank history, and an ERB then take it to the main finance building

SGT (Join to see) - I passed my board, and was pinned 7 months later. I had no flag, was in good standing all that. I didn't get back pay nor did they backdate my promotion orders.

Why I am saying this, is that they most probably will do nothing. It is an uphill battle.. I just let my experience tell me how uneven the loyalty between me and the Army really is.

DOR is from the date of orders, not the day you passed a board.. from what you posted, you were not owed back pay.....Unless the orders were delayed though what was later deemed a mistake. .. IE. My promotion to MSG was held up for several months, as the security clearance was erroneously reported as "suspended" Once I got OPM to fix that... I was promoted, DOR reflecting the date it should have been, and back pay authorized.
Enlisted promotion to Sergeant E 5 is done buy recommendation, local board, then OML.. Nothing more then HRC deciding how many to promote that month, looking at those on the list and what there promotions points are, and then they set the promotion points number at a quantity that gets them to the number of SM promoted they want.

If you "made points" for say Jan 16, but for what ever reason were not promoted on orders till Aug 16... then you are due a DOR correction and back pay... Its not even a question so long as there is no unfavorable actions on file for that time period (perhaps one you don't even know was done, or one entered by mistake)

SGM Erik Marquez - Absolutely! I didn't go into detail. But to summarize, I got orders 7 months to late because a change of admin systems. They knew about the slip 2 months in, and then slowly fixed the issue for 4 months. Now, THAT is just pure disrespect the individual.

When I went to the board for my SGT... I was the only one that went to the board, thus the only one that passed... for 11 empty slots. There was people that went to the board 3 months later than me, and we still got the same DOR. Bullshit I think is the common term.

When were you taped, and why do you mention that the flag was wrong? In what way was it wrong, you weren't taped correctly, you didn't burst tape, what was it? SGT (Join to see)

I was taped February 2015, is was erroneous because they taped me wrong and i failed, i was re taped the next day by and MFT medical officer and passed.

The points come out the last week of the month so when did you get raped, before the points or after. If it was after the points i smell something shady, especially if you weren't giving time to go through the steps outlined in AR 600-9. You must do 7 different Memorandum's, which includes dietitian, and blood work to make sure you don't have a thyroid issues, then the flag gets initiated. If you have thyroid then you'll be put on a profile, if not you should be flagged.

SGT (Join to see) this sounds like a case of making up for a lost time. I say that because if you were picked up on the 1st of Feb 2015, and you were a flagged on the 22 it seems as if your leadership didn't want you to get promoted. Also they did this not knowing clearly what the regs said about Soldiers on the promotion standing list. This is not your fault so you should be promoted with the DOR of 1 Feb 2015, and should get the back pay to reflect that date. Now back to reality you shouldn't put your self in the position to get unfavorable actions because not many leaders will try to assist you after you've done so. Senior NCO's look at that like a slap in the face, and don't want you in the Corps for that simple fact. Just my two cents. Welcome to the Corps, Lead, Develop, and achieve.
