I have lived off post while dealing with getting my wife and son command sponsored. When I arrived at my current duty station they gave me a barracks room, but housing won't let me turn in the barracks key until my orders are re-cut to include my dependents. I read AER 55-46 and all I'm seeing is that command sponsorship will be backdated to when I began the packet request. What I'm asking is will Housing likely try to screw me over once my command sponsorship is approved because "I've had an assigned barracks room during this time." Or is there something in writing to back me up? I don't use the barracks room at all, but they will NOT let me turn in the key until I have new orders. Thanks in advance.

Incorrect. Your command sponsorship will be dated the day it was approved. You are currently overseas and brought your family prior to the being command sponsored which I’m pretty concerned on how they even got to your duty station if they weren’t on your orders.... You received a barracks room because you do not currently have command sponsorship meaning that your choice to live off post is your decision and will be out of pocket. No back pay is authorized.

And if you are in Germany, I hope for your sake you are not in a location that requires you to live on post.

According to AER 55-46: "When the approving authority grants command sponsorship, the latest of the following dates will
be the effective start date of the command sponsorship:
(1) The date the Soldier requested command sponsorship.
(2) The date Family members arrived in the command.
(3) The date the Soldier extended to meet tour requirements.
(4) The date the tour status changed."

So according to that I should be good, but I'm just wondering If the housing office is legally allowed to refuse my return of the barracks key, seeing that my command sponsorship packet has been submitted for request months ago.

What I am telling you is that if you went from CONUS to OCONUS, 55-46 doesn’t apply to you. Your family should not be in country if you were not granted command sponsorship prior to arrivalSGT (Join to see)

SGT (Join to see) you read it yourself. The LATEST of the dates. Your family should not be with you if you weren't command sponsored. In fact, you shouldn't be living off post if your family isn't command sponsored. This is exactly why you don't move family members if they aren't command sponsored. FYI, they aren't arrived in the command until after they're accepted into command sponsorship.

As far as finance is concerned, you took an unauthorized action on yourself and brought your family out before being sponsored. That was your choice and does not obligate the Army financially for your choice. Especially since there is already a process in place to pay for them to be with you that you chose to circumvent
