This is a general question. If you have a soldier who refuses to listen to you, as a non-commissioned officer, do you simply put the incident on paper?

Example given- A soldier has unauthorized sunglasses on in a formation. You tell the soldier to take the sunglasses off. He/she refuses.


On the 4856, do you recommend for UCMJ? I've gone thru 600-20 and cannot find anything regarding this

I refused to follow a order given to me by 5 different nco's. They yelled and threatened and swore they would art. 15 my ass. In the end they gave up and did nothing because i was right.

The private was out of uniform and disrespect to a NCO, I would push for a article 15 with the CO

If you told him/her to take them off and they refuse, have them meet you and your SQD LDR/Section SGT at a particular place and time. At that time, you counsel his ass in front of the SQD LDR/Section SGT, and give his happy ass the Magic Bullet and he initials that b*tch. Make sure that your corrective training is in line with the offense, and follow through with it. Once you write the 4856. it now falls on YOU as the leader to make sure everything is done to the "T". Should the Soldier refuse to sign, you write in the signature block refused to sign, and counsel his/her ass again on what they're signing their name to in regards to counseling statements. IF this happens again, you counsel his/her ass again and NOW add the part where you ARE recommending this Soldier for NJP (make sure to say RECOMMENDING being NCO's can't give NJP). Before you do, talk with the SQD LDR, PSG, or Section SGT and make sure they're on board with this. Explain your case, and make sure you have been doing your monthly's on him/her. If you don't have your end right, while that Soldier will be taken care of, YOU WILL TOO. Nothing worse than you doing your end, and 1SG hears about it before the PSG does. Maybe you could solicit ideas from them on a better approach than NJP. But if you told him/her twice, write it up, send it up and allow the NCO Support to do their thing along with the Chain of Command. I remember in my early years, two 4856's of the SAME OFFENSE guaranteed you a trip to visit the PSG, who will read you the riot act, counsel you and recommend you for NJP. All the times I saw this happen, EVERY single time the Soldier was given the Art 15.

No matter WHAT you may feel, what you may want to do, or how angry this Soldier makes you, DO NOT sink to their level, DO NOT touch the Soldier in ANY way, and maintain your professionalism. If this Soldier knew you before you were promoted, they're trying you thinking we were friends before, and not recognizing the new you with the additional responsibilities of a NCO.

You tell said troop he has a choice to make he can remove said glasses and do some pushups to remind him who is in charge or you can counsel him and recommend a article 15 to the CO or the rest of the PLT/Squad will do pushups until he removes them which will also result in a Counseling-Article 15 but then the rest of his "Hommies" wont be very happy with him. now when you make these recommendations to him pull him off to the side and do it in a low voice no matter how PISSED you are. Reality is he probably gave you a gut reaction without thinking first he may of been having a bad day or week ect ect when he said no now he's backed into a corner and doesn't want to lose face by backing down publicly but you give him a opportunity to do it discreetly then you both win. I had this very thing happen on a deployment one time that's how I handled it and it worked out well never had a problem with him after I also talked to him off line to see what the real issue was later. assumedly you know your guys if this is a ongoing issue then you will have to handle it differently

The army in the present we have to be careful on how we do things or a matter of fact be politically correct on how we do stuff. Think and ask for guidance from someone who has been in the service for an extended period. There is and old saying keep a still tongue and a wise head.

In the old days NCO would take the sunglasses off of the soldier then proceed to teach a very hard
leason to such a person.

In my day, he would have removed those sunglasses or be subject to disobeying an order. My troops would never disrespect me like that.
