This is a general question. If you have a soldier who refuses to listen to you, as a non-commissioned officer, do you simply put the incident on paper?

Example given- A soldier has unauthorized sunglasses on in a formation. You tell the soldier to take the sunglasses off. He/she refuses.


On the 4856, do you recommend for UCMJ? I've gone thru 600-20 and cannot find anything regarding this

that formation would not end with him not facing the 1SG , and life would turn downhill fast,

Since the soldier saw fit to disobey your lawful order in front of the entire formation and usurp your authority in front of your command, the response should be immediate and in front of the formation. "PVT Snuffy, if you do not follow my order to remove the unauthorized eyewear immediately, you will leave me no alternative but to refer the matter to command for appropriate disciplinary action consideration up to and including the possibility of criminal charges being filed under the UCMJ with all unit members present at this formation being subjected to interview for the purpose of providing testimony against you." If they then fail to immediately correct their unacceptable behavior, immediately take action. As a leader, NCO, CO or WO you cannot allow a subordinate to disrespect you in front of your command without immediate correction and consequence.

first find out if the Soldier has a medical condition that authorizes the soldier to have them on the first place (this is where the regs come into place) The soldier should have some form of documentation if so the soldier needs to produce it on the spot,If the soldier has no such documentation then you tell the soldier to take them off if he refuses then you see the soldier offline after the formation. you verbally counsel the soldier then you write him up per 4856-e by this the soldier should be in front of the first Sergeant as to why him/her refused a lawfully order from a Non Comissioned Officer

Well the is a tactful way of doing it and if not I would simply write him up and recommend a Art 15 for dis obey a direct order.

No UCMJ I Myself will not be disrespected in front of my team I am a team leader for that I handle it this way .If in formation I ordered a team member to remove the unauthorized sun glasses I would repeat the command one more time and if the member still refuses we will all stay in formation until they come off which I would think wouldn't be long

Put it on paper, if I'm nice that day show the soldier the regulation. Mentor that soldier I stead of giving correction.

For this example, a few factors are important. the most important factor is time, how much time do you have to make the correction. If you don't have much time, you have three choices; let it go; or make sure someone senior ranking like the platoon Sargent takes notice ( if this is a platoon formation or company formation). If it's your formation, make every one push while he stands in front of the formation for not policing their battle buddy until he takes his glasses off. Once his glasses are off; you let him know he's getting counseled. You have to put it on paper. This joe will continue to try you till he gets his first bit of extra duty.
