Okay I am not talking about me by the way. But I was intrigued by the question and I can’t seem to find an answer anywhere. I’d like to know if the mexican government would support the return of the soldier for court martial, how he could be apprehended or if he could even make it to the border anyway. Suppose he is CONUS by the way.

Easy to make it to the border and you can just walk over. The Mexican Government would have no problem with the soldier as long as the soldier can pay his/her way.
Break the law and will server jail time in a Mexican Jail, not a nice place.

Without getting to far out of my lane and into the legal weeds basically a few things happen. You fail to report to your place of work/duty (chargeable offense 1). If this was deemed and proven to be intentional this can be considered desertion of post (depending on circumstances). After 24 hours you can be charged AWOL (absent without leave). There is a standard procedure for extraditing people between states and even nations. The different agencies have legats who are experts in international law and extradition treaties and they initiate a process to have you returned. Some nations have agreements with us, some do not and others still dont honor their agreements. The process is initiated and the accused is flagged in US and international criminal wanted databases. Then everyone waits to see if the person returns or if they are extradited back to the US.

Article 80 Unauthorized Absence, Article 85 Desertion, Article 86 Absent Without Leave, Article 87 Missing Movement, said person could and probably would get each one. At the very minimum, they could Administratively Separate the person with an Other Than Honorable characterization of service at the maximum a Warrant could be issued for the Soldiers Arrest. Once in Custody the Soldier could be processed for Court-Martial.

Unauthorized Absence: Gone more that 30 Days and Apprehended by Authorities
- Dishonorable Discharge
- Confinement: 18 Months
- Forfeiture: Total
Desertion - In Time of War
- Death, Dishonorable Discharge, or Bad Conduct Discharge
- Confinement: Life
- Forfeiture: Total
Desertion - Intent to Avoid Hazardous Duty/Shirk Important Service
- Dishonorable Discharge or Bad Conduct Discharge
- Confinement: 5 Years
- Forfeiture: Total
AWOL
- Bad Conduct Discharge
- Confinement: 6 Months
- Forfeiture: Total
Missing Movement - Through Design
- Dishonorable Discharge or Bad Conduct Discharge
- Confinement: 2 Years
- Forfeiture: Total

We also have an extradition treaty with Mexico, they ship us criminals all the time.

To reiterate my original post, this was not about me, never considered it, never will. I now think I should've probably worded this better. This was just a hypothetical, I was bored one day and thought of the "what if" scenario. Kind of a "what would happen if I burned the barracks down?" We all know it's not a great idea, buuuut, there was no information anywhere on a not common but real thing. I appreciate the one's that gave a direct answer, and I apologize to the one's that thought I was yeeting to another country.

OH! You're talking about Trump, aren't you? Mexico would definitely return him, but he received so many medical deferments from playing too much golf that the military wouldn't have been able to do anything with him anyway. They would have called his mommy and she would have had the nanny pick him up in time for his afternoon bubbly bath and nap. Didn't Trump campaign on forcing Mexico to pay for the wall? How ironical.

Yes, the Mexican government and every other government in the world would support the return of the soldier for court martial. The BEST thing the soldier could do is to turn himself in at the border, on the way back into the US, if he's already crossed into a different country. Then he should BEG the military to take him back, and if they refuse and decide to prosecute him he should plead temporary insanity. They'll probably kick him out on the basis of a mental disability. THIS HAPPENS ALL THE TIME!!!

The military is really only good for people who have strong political connections and whose family members have been high-ranking officers. Everyone else gets shat upon, but it is a good way to get a few extra bucks for college ... but not that good because you're essentially signing your life over to the care of some of the dumbest and cruelest people on the planet.

I believe that Mexico would not return deserters if they faced the death penalty.

Unless you are conscripted you can not use consciousness objector!
