Currently separating bc of family issues
NCO said once I get orders I get 10 days to clear out. Well, Dec 2021 I cleared CIF and Housing and moved to LA, CA.

Out of 120 days of leave, I used 20 during Christmas leave and NCO said He and 1SG agreed that should just move out and take January leave (unofficial, no leave form, just leave) and come back at the end of January to clear post and sell 60 days of leave.

Today, another NCO called me and turns out that 1SG and NCO didn't tell anyone how THIS WAS GOING, meaning that I was on January leave so I wouldn't waste my leave days without having an official leave form approved.

I have to report to base at 0600 like a normal day but I have no housing, daycare, nothing on post. The NCO is in some school now and the 1SG retired last week.

I was given the go ahead to clear house and take January leave but apparently neither the 1SG or NCO told the CDR of what was going on.

CDR said I have to report tomorrow or I'll be reported as AWOL. I have no one to help me with my kids and the only person is in Colorado but I can't PCS until Dec 2022 and going through Child Custody has made it difficult to stay in the military, mom often takes the days longer than court allows and cops are always involved and if I choose to not release the kids to her (bc I know that she won't return them) she shows up at the base and it gets reported up the chain of command that I'm violating a court order.

I can't live off post on this base bc is too far from the closest city.

Have you talked to your Commander and told them all this? This sounds like sounds like something that can be very easily handled. They put you in a barracks room for two weeks, you clear and take your 120 days of leave. Problem solved.

If you don't, you will be AWOL and dropped from roles

NCO said I couldn't take leave bc family separation doesn't allow to take terminal leave. I never spoke to CDR about it because everything was going through NCOs but I'm speaking directly with him today instead of using NCOs.

Unofficial Leave? No such thing. If the Commander feels so inclined, you can be popped for AWOL right now. And a 1SG NOT telling the CDR about a Soldier within the unit being given free reign to just up and leave? Not gonna happen. 1SG doesn't have that kind of authority. How did you clear Housing and CIF without discharge orders? How did you get your HHG from base to LA without orders? I'm sorry but your story smells of more BS than the PBR Nationals

CDR gave me a signed memo and I did the move myself because there was no availability for the army to move my stuff and I didn't have orders either.

You don't have to believe me, I posted to see what you guys think but If you believe it's BS then that's fine

I know there's no such thing but I'm saying is that I was told that it was okay for me to leave and when I asked he told me "Nah, you good, go ahead and clear CIF and housing"

SPC Ben Alex you left base based on someone saying "go ahead." Beyond stupid. Especially without a leave form. Not to mention the Chapter process isnt even done. You don't even have a 214 in hand yet. I'm saying it smells of BS because I've been playing this game a long damn time and nothing of your situation sounds even remotely ok.

SPC Ben Alex - It doesn't matter what your 1SG told you, he has no authority to do anything you said he did. Why did you ever leave without some type of paperwork authorizing leave? This is a giant clusterfuck and you helped create it.

There is always more to the story that someone posts - because all we have is your POV. Your POV is skewed, like anyone's POV is when they tell a story.

First, report as ordered even if you have to bring your kids. You don’t want to start down an AWOL and court martial path. Next talk with Commander. If you actually have leave days, he may allow you to use some to get yourself descrewed. Also there’s legally no such thing as unofficial leave. You’re either on duty or on leave. SPC Ben Alex - Even if you have something in writing from your 1SG - that's still not authorized leave. At all. Because the 1SG has no authority to authorize leave or to do anything you said he told you was ok to do.
