Who must I speak with to investigate the determination of a disability claim? I do not agree with the VA

Pre-existing condition from high school military said they would fix the problem two surgeries later problem still isn't fixed was diagnosed with sleep apnea from the VA, am I wrong to think my sleep apnea was service related I feel that made it worse. Any guidance?

If Sleep Apnea isn't in your medical record prior to discharge, you typically won't get it. Same goes for other conditions that come with age. That's why I recommend any snorer get a sleep study prior to getting out. Interesting that ADs who have it are typically being kept in by the retention board even though it's usually a 50% thing with VA. Quite the niche market for Camo CPAPs. Re: the high school thing. VA is on the hook for problems created by the surgery, not that it didn't correct a pre-existing condition.

SFC Bryson Amaral, your best approach is to work with a local Veteran Service Organization (VSO). They have the authority to act on your behalf and represent you back to the VA. While I don't know the details of your condition, this is the most effective way to appeal any disability decision.

I work for the VA on the benefits side of the house and a veteran. I agree with LTC Strickland get a veteran service officer (American Legion, Disabled American Veterans, etc). There are several organizations out there that support veterans and help them with claim process, I even have one; thats best advice anyone can give you.

Were you diagnosed with sleep Apnea while you were in the service? If not, they will fight you. Open a case through E-benefits, using the VIacapp (sp) system. Also, get connected with the DAV or Am Vets. Get all the paperwork, DD 214, and all relevant medical data together before you start with e-benefits or anything else.
