I am a 100% disabled veteran due to PTSD. What must I do to be qualified for military burial and plots? Do my spouse qualify for benefits after I die? Does she qualify for military funeral services for me and for her?

Thank you for your service. We are not with the VA, but try to explain the benefits to veterans like you and provide insurance, financial planning, and other assistance to support the financial independence and security of military and veteran families.
As an honorably discharged member of the US Military you are eligible to be buried in a Veteran's Cemetery, with headstone/marker, flag and perpetual care in that cemetery (see cem.va.gov). This would be true, even if you did not have any disability. You spouse can also be buried with you in the VA cemetery.

As a veteran with a 100% disability, you receive disability compensation to support you and your family when you are alive. When you die, that payment stops but your spouse may be eligible for Dependency and Indemnity Compensation (DIC). If you have you have had the 100% rating for 10 years prior to your death, your widow would be eligible for DIC regardless of your cause of death. (If less than 10 years, your death would have to be from a service-connected condition). Currently, DIC is a tax-free payment of $1,340 per month and if you were totally disabled for 8 years prior to your death she would also receive an added $285 per month.

As a veteran, you are entitled for burial at any VA National Cemetery that is still open. Your wife can be buried with you. Here is a link to more information --

Dear SGT Jarmon, Thank you for your question and your service to our country. The Department of Veterans Affairs (VA) has a number of burial benefits for eligible veterans. Burial benefits that are available include a gravesite in any of the 136 national cemeteries with available space, opening and closing of the grave, perpetual care, a government headstone or marker, a burial flag, and a Presidential Memorial Certificate, at no cost to the family. Some veterans may also be eligible for Burial Allowances. Thank you for your question. Preparation is essential to take care of our loved ones. When a veteran passes away, the VA compensation payments to the veterans will stop. The surviving spouse can file a claim for Dependency Indemnity Compensation, Death Pension, and/or Accrued Benefits by completing VA Form 21-534 to determine entitlement to benefits. When you mention rights, do you mean benefits? If so, there are a variety of benefits offered by the Department of Veterans Affairs to surviving family members of deceased veterans that you may find helpful. There are three programs in particular that I recommend that you look into initially, two of which are financial and one is healthcare related. The financial programs are Dependency and Indemnity Compensation (DIC) and Survivor’s Death Pension. DIC eligibility is determined if the cause or a contributing cause of the veteran’s death was a result of their military service. Eligibility for the second program, Survivor’s Death Pension, is partially based on the applicant’s current income and assets, and does not rely on the cause of the veteran’s death.

The last program is CHAMPVA. CHAMPVA is a type of health program offered to survivors when a veteran's death is service related. It could help cover copays on medication and medical visits along with other eligible expenses.

Have talked with several helpful intake workers over last 8 months after spouses passing. Appreciate all the help I have had negotiating the complicated VA process with my spouses claim since his passing 8/19. The intake office has been a kind of anchor of hope through the devastating loss of my husband.

If you have a disability that is related to your military service then you may be eligible for additional compensation and certainly treatment in VA medical facilities.

When is the next open season to add spouse in the Survivor's Benefit for retirees who didn't elect a spouse beneficiary before? Last open season was back in 2004.

I’m the widow of a retired and 100% permanently disabled Navy Veteran. He was 3 miles offshore in Vietnam and we had always questioned about the agent Orange he was subjected to. The answers started with a NO, not unless he was IN brown water. Then the answers went to, well we can put it in your records but you’re already at 100% and it won’t make any difference. Now that he’s gone I’m hearing that they are FINALLY awarding to the Navy Vets that were in blue water. My husband told me of it blowing over the ships and the water they drank and showered with was filtered with that junk in it. So my question is, since when he passed away they took ALL of his income away, is he/me eligible for this award? I’ve been left with DIC @ $1600pm when we were bringing in $7000. So to say my life has changed is putting it mildly. I was his unpaid caregivers for 20 years and am now disabled. So yes, I’m asking if this is something that I could benefit from. Thanks. Donna A

Ms Auld. Very sorry for your loss. We are not with the VA, but try to explain the VA ratings and payments to veterans and survivors like you. The recent consideration of "Blue Water Navy" personnel has no effect on his benefits or your benefits, since he was already 100% disabled. The disability compensation for your husband is paid to him when he was alive. After he died, you became eligible for VA Dependency and Indemnity Compensation (DIC) of $1,340 and an additional special payment of $285. So, although this is significantly less than previous payments, that payment is consistent with what our experience with other survivors receive from the VA. You may also be eligible for survivors benefits from Social Security. If you husband selected to pay into the Survivor Benefit Plan when he retired, then you could be eligible for a SBP annuity from the Defense Finance and Accounting Service.
Although this may not be the answer you wanted, I hope it addresses your question. Mike Meese
