Could this be an act of war? It depends on the location of the ship. Was it in international waters? Was this intentional given that our standing in that part of the world has taken a hit in recent months as a result of the Nuclear negotiations with Iran.

Iran Intercepts Cargo Ship, US Moves to Respond
Iranian vessels fired upon a cargo ship flagged to the Marshall Islands Tuesday morning, forcing the ship to travel deeper into Iranian waters — and setting off another round of tensions between Iran and the US.

1. The passage in the gulf is small enough, that part of it is all Iranian waters. Under the law of the sea, with the innocent passage, ships are allowed thru.
2. Iran took a ship from a nation under US protection, or a US cargo ship since cargo ships changes flags several times in its cruise, usually based on where they last came from.
3. People from Marshall Islands speak English, so I wouldn`t put it past the idiot Iran Navy to call them Americans, and US sailor also includes more then just US Navy Personnel, it also includes Coast Guard, USNS, and any American who is a sailor abord that ship. So the Pentagon can say they lost no one to Iran, since the rest are not part of the military.
4. This is most likely retribution for the US and Saudi Navy ready to intercept that Iranian fleet, which forced it to turn around whether it had weapons or not if it entered Yemen Waters.
Though regardless of the reporting, Iran just made good on a threat to possibly block the Straights of Homuz, and seizing a ship under US ownership or protection.

1) 40km~ (21nm~) So over half of that is their territorial waters.
2) Marshall Islands has a Defense Treaty with the US. They are American in all but Name. It's kind of a weird relationship.

Looking up Maesrk, the company that owns the ship, it belongs to a Company headquartered in Denmark. Which is part of NATO. Though its more a EU problem then US problem.

The Pentagon has confirmed that the ship was in Iranian waters when it was seized. The ship is Danish owned and registered in the Marshall Islands. Ships normally don't have a problem crossing through Iranian waters in the Straits of Hormuz, I wonder why this ship was treated differently.
