Here's a thought.... how about letting the affected Guardsmen keep the money by taking away money given to those who are illegally residing in California. *drops mike and walks off stage*

In my view this can be fought and I have no idea why some of the Soldiers are paying the money back. As mentioned in the article the Army Board for Correction of Military Records #1. Easy to file an appeal to them, yes it sometimes takes a few months before you hear back but they will investigate it completely and have the ability to wipe the record clean everywhere at once. If that did not work, Letter to Military Affairs person in your Congresspersons office #2 usually always has a impact with Army Finance to get them to back off.
