This came from the "gang of six", not from the Dems. Lindsay Graham came with Durbin to present it. Gang of six has Dems and Repubs represented.

Most of the so called kids the media keeps harping about are in there 20's and early 30's. I think they have had ample time to figure out they are illegal immigrants. And should have already been working on their citizenship. I don't have a problem giving them a path to become citizens if they so choose but not automatically. We need to discontinue DACA, chain migration and the visa lottery.

Birthright Citizenship to children born to illegal immigrant parents is a magnet for illegal immigration.
The Citizenship Clause of the Fourteenth Amendment to the United States Constitution indicates that "All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside." The Supreme Court of the United States affirmed in United States v. Wong Kim Ark, that the Fourteenth Amendment guarantees citizenship for nearly all individuals born in the United States, provided that their parents are foreign citizens, have permanent domicile status in the United States, and are engaging in business in the United States except performing in a diplomatic or official capacity of a foreign power.

As of 2015, there has been no Supreme Court decision that explicitly holds that persons born in the U.S. to illegal aliens are automatically afforded U.S. citizenship.

Edward Erler, writing for the Claremont Institute, said that since the Wong Kim Ark case dealt with someone whose parents were in the United States legally, it provides no valid basis under the 14th Amendment for the practice of granting citizenship to U.S.-born children of illegal immigrants. He goes on to argue that if governmental permission for parental entry is a necessary requirement for bestowal of birthright citizenship, then children of illegal aliens must surely be excluded.

In most cases, there is no way for them to work on their citizenship. Their parents did them a great disservice. Unfortunately, the way the 14th Amendment is worded is the law of the land and American citizens are born everyday to illegals. If they ever overturn the intent of this, or if we elect to change the 14th, do we take away the citizenship of thousands, if not millions, of people? Do we award citizenship to babies born here of legal parents but not illegal parents, do we split hairs between visa visitors that are within the guidelines and not award it to overstays that entered legally and became a visa overstay? That would be a nightmarish task to get that specific. Immigration law is very complex and there are multiple variations to just about every scenario that can be imagined.

I don't advocate for the abolishment of the fourteenth amendment. Yes, it is the law of the land, but it is not that cut and dry about the status of babies born here by illegal aliens. The Supreme Court could rule as to the definition of how the 14th is interpreted without abolishing the amendment. There is no need to take away citizenship from anyone they could be grandfathered. But going forward we could change the practice of automatic citizenship to babies of illegal aliens. And taking away the incentive of crossing the border illegally hoping to be granted citizenship. The ruling on the Wong Kim Ark case dealt only with someone whose parents were in the United States 'legally'. 'In most cases, there is no way for them to work on their citizenship.' That is why I suggest a pathway (an easier pathway) for them to obtain citizenship but not just automatically granted. It still must be earned. As for visa overstays we need to monitor those visas. As it is we only keep track of who enters not who is here on expired visas. Half the illegal aliens in America are here because of expired visas and that should not happen.
