This is one of those situations where I can see both sides of the coin and partially agree with both sides. Yes, it is expensive to maintain inmates. What prison DOESN'T cost a lot of money per inmate? Yes, I do agree that some terrorists use it as a propaganda tool to recruit.....but this isn't the main piece they would use. I would venture to argue that Gitmo is more of a side note topic used in recruitment. But, I also agree that when terrorists, who by their very nature, disregard human rights with their actions surrender their rights and are to be kept in a location where they can do no harm anymore . Plus, if you really want to look it, they get better food/medical/housing than what they would in the field. And, if any US citizen is captured while they are fighting for a terrorist organization, then they fall under that same category of surrendering rights.

Anyone who sees a clearcut answer to this question simply isn't looking hard enough. We are in uncharted waters here, legally speaking. I have long advocated that non-state combatants be treated under the same laws which were applied to pirates on the high seas (also non-state combatants). Sadly, nobody listens to me, not even enough to tell me to shut up and go jump in a lake.

I am listening, CPT Jack! Great comment! I agree! We released 730 unlawful combatants, 30 percent of which are known or suspected to have returned to the fight; what about the 70 percent we DON'T know about? Where are they? You're neighborhood? Releasing all but the most harmless unlawful combatants prior to the end of hostilities is unnecessary and dangerous. Keep Gitmo open and then fill it up! Hooah!

Unless of course they are an unlawful combatant. Americans can be enemies. Read about the Civil War, Habeas Corpus and Abraham Lincoln. Facinating challenges for the Constitution, law, and the preservation of the United States.

MAJ Montgomery Granger - Unless nothing. If they are American citizens, we must comply with the Constitution. If not, we go down a very, very slippery slope. "Unlawful combatant" (whatever that is) today,, maybe a person with a different political opinion tomorrow,, or maybe a different skin color? or maybe a different sexual preference?
I would wager you are a strong supporter of the 2nd Amendment, yes? So, does this US citizen, this "unlawful combatant" have the right to "bare" arms or not?
Our Constitution has much more to it than just one amendment, one guaranteed right.
