It doesn't seem likely he will prevail. To be honest, I'd be surprised if the SCOTUS even took up the case.

I read the article. He received a conviction for statutory rape in South Korea (he claims he thought girl was of legal age) and served jail time back in 2004, but the Army decided to let the NCO continue service and even reenlist. New military regulation in 2013 ordered separation of personnel convicted of sex offenses.
Issue is whether delayed dismissal is lawful in this case...
