Eastman's wrong, and is adding words to the Fourteenth Amendment that aren't there. Isn't it funny that the Republicans only pull out this birtherism card for black candidates?

CPT Jack Durish - you didn't read the original article that Eastman wrote for Newsweek, did you? In the Newsweek article, Eastman almost immediately goes to the 14th Amendment argument, stating that Harris isn't a citizen, because her parents were not subject to the "complete" jurisdiction of the United States, but as aliens, were only subject to the "partial" jurisdiction. He's inserting crap that isn't there, and hasn't been ruled on by a court.

"The language of Article II is that one must be a natural-born citizen. The original Constitution did not define citizenship, but the 14th Amendment does—and it provides that "all persons born...in the United States, and subject to the jurisdiction thereof, are citizens." Those who claim that birth alone is sufficient overlook the second phrase. The person must also be "subject to the jurisdiction" of the United States, and that meant subject to the complete jurisdiction, not merely a partial jurisdiction such as that which applies to anyone temporarily sojourning in the United States (whether lawfully or unlawfully).
"Interestingly, this recitation of the original meaning of the 14th Amendment Citizenship Clause might also call into question Harris' eligibility for her current position as a United States senator. "
Therefore, Eastman is basing his argument on the 14th Amendment, including his various citations to cases in which he cherry picks dicta to support his fallacious reasoning. Interesting how he never brought any of this up when Ted Cruz was running for president. Hmmmm. Wonder why?
