It's not a "death panel", it is a question of available ICU beds and the chance of survival. If the patient did not care enough about their own health and the health of others, why should they get an ICU bed which could be used for someone that is likely to survive? And of course, if there are sufficient beds, it wouldn't matter, everyone would get in.
This is no different from what they do at a front line battalion aid station, or at the combat support hospitals. Someone who has a better chance of survival will get care over those who don't, but the goal is still to save as many as can be saved.
