Anyone remember that nurse in Utah who refused to draw blood from an unconscious patient, based on hospital policy and the 4th Amendment? School or no school, constitutional rights always apply. You want bodily fluids? Get a warrant. You want to suspend my kid because you want to violate constitutional rights? OK, I will see you in court.

That's very true! However, that patient was unconscious, and could not give his own consent. In that case a warrant was needed. In this case, the parents consented because of district policies.

SGT Aaron P. - Submission to authority is not consent. The old, "if you have nothing to hide, then why resist?" line implies that we don't need the 4th or 5th Amendments anymore.

Well put SSG(P) (Join to see), and I agree! You simply DECLINE the sample, face the consequences, and fight your fight! But the fact that the PARENTS did in fact take them to give the samples, is still consent. It would be a completely different argument, if the kids had medical staff come in and draw the blood without the parents consent. Now, if a parent declined and the kid was suspended, then there would be hole new topic for us on that being a violation of the 4th, or 5th Amendments.

I'd say sure... after you provide results of testing for every single employee of that school. Otherwise, go #!$# yourself, and I'll transfer my child/children to a different district and let them get the money for the head count (yeah, we can do that in Michigan).

I would not have complied simply bc we have a beer free zone around our sanctuary children. Its interesting which laws are enforced and which laws are allowed to go unpunished.
