Interesting, we have a similar situation here in Tampa at the intersection of I-4 and I-75. The claimed largest Confederate flag in the world flies there on land owned by The Sons of Confederate Veterans. Courts have ruled that since its on private property its perfectly legal. If the court in Tuskegee finds that the land is still being used as a park for white people there probably isn't much chance of the monument going away.

To defend against all enemies foreign or domestic. Enemies do not have the right to have monuments period. That’s like putting an IRAQ or Afghan monument in the middle of DC.
