This is tough. The problem with pulling a gun during a mass shooting is that if the cops are following procedure you may get shot by them as well. Really seems like a tragic mistake but I think the city should suck this up and pay up simply due to the lives this man probably saved.

This will be a difficult case for a jury. One key point was the good samaritan picking up the rifle to drop the mag. Not a good idea in my opinion. Once you have stopped the threat either place your weapon in your holster or on the ground. Keep your hands where the police can see them.

One point in favor of CCW permits is that they may be displayed in place of an off-duty police officer's badge in situations like this. Police countered such cop-on-cop "friendly fire" incidents involving plainclothes officers with the "color of the day", but there is no such system for legally armed "civilians".
