I understand the use of prosecutorial discretion, but this guy just chose to not prosecute laws he personally didn't agree with. That ain't good.

Sgt (Join to see) - Actually, people closing their mind off because they won't listen to anything other than their party's favorite news channels. How many people even here on Rally Point refuse to read a word from Fox. I suppose bigoted people will be the downfall of our Country.

There are a whole host of people in the justice system, on the right and the left, who do this. For the right, the term is "Constitutional Sheriff". Those are sheriffs (usually elected) who refuse to enforce the law if they feel it violates their personal interpretation of the Constitution.

PO1 Jeff Chandler - Exactly, as do the DAs. Many years ago when the "Oath Keepers" were new I looked into them. It sounds like a good idea, continue to support the Constitution. But then I found out what they really meant, they meant their own personal interpretations, completely usurping the power of the legislatures and judiciary. It was at that point I recognized them for what they were and it was no surprise to me that they later got into trouble, nor the type of trouble they got into.

PO1 Jeff Chandler - The DAs are attorneys too. We can almost always find an attorney to support whatever crack brained legal theory we have. That especially includes Constitutional Sheriffs.

PO1 Jeff Chandler - The second amendment, like all Constitutional law has been through many legal interpretations since the founding. From your comments you are not OK with executive government officials ignoring statutes and case law when you don't agree with the Constitutional conclusions they are coming to. But you are OK with it if you agree with their conclusions. I hope if you think that through you will see the problem with that position.

You can't claim to be a Constitution supporter when you ignore the parts of the Constitution that specify who makes the law (legislature) and who deals with conflict in the law (judiciary) when you don't like the outcome. Those are the Constitutional controls. Not you, not me, not some sheriff somewhere, nor a Florida DA.

PO1 Jeff Chandler - The sheriffs are also refusing to arrest which is pretty much exactly what the DA is doing. The legal action part, great. That's what they should be doing and if that were all they were doing that would be fine.
