Where in our Constitution does it say that basic human rights are restricted to only US citizens?
In another of our grate documents:
"We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness."

Sgt (Join to see) - The Constitution applies to anyone on US soil - citizen or not. Pretty much the only thing that is afforded to citizens only is the right to vote...but even then that gets stripped from people convicted of felonies.
"When the terms “resident” or “person” is used instead of citizen, the rights and privileges afforded are extended to protect citizens and non-citizens alike. Moreover, protections under the 14th Amendment ensure that no particular group is discriminated against unlawfully."

MAJ Montgomery Granger - We are not in a state of war! Have not been since 1945. Those people being held at Gitmo should be tried, and if convicted, sentenced to the appropriate place. If found not guilty, they must be released. In the case of Khalid Sheikh Mohammed, he was already guilty by a military tribunal. Send him to Florance. He can be a cellmate with Abu Hamza al-Masri.
