The Bexar County sheriff’s office’s latest move signals the office has wrapped up the investigation into the incident, according to The Miami Herald, which first reported on the recommendations, and prosecutors will now decide whether to follow them. Top DeSantis aides could reportedly be involved in the case.

The development comes as DeSantis runs for the White House in 2024. Also on Monday, California’s attorney general said the state of Florida appears to be behind a group of South American migrants who arrived at a church in Sacramento, Calif., via a private flight. "

They walked onto the plane of their own volition. Not under force or threat of force. Not at gunpoint.

They walked off the plane of their own volition.

Unlawful restraint seems a bit far-fetched to me.

If you argument is that they were lied to, that would be fraud. And, unless the county was the one defrauded, Bexar County Sherriff and DA has no standing. Those passengers would, but non eof them seem to be complaining about the free plane ride.

I will see how it plays out, because I do not have all of the information, and I am not a legal expert. But it LOOKS to me like this is an overzealous Sherriff trying to make a name for himself, not one trying to uphold the law.

All that being said, I think DeSantis was stupid to do this. Worry about the migrants in Florida, and let Texas handle Texas.

If consent was obtained by fraud, as it apparently was, then the consent was not effective. Second, the Sheriff doesn't need civil law standing, his duties under Texas law is to enforce the criminal statutes of Texas. Third, you may want to read the definition of "restrain" at Texas Penal Code, Section 20.01 (1), which states:
------
(1) "Restrain" means to restrict a person's movements without consent, so as to interfere substantially with the person's liberty, by moving the person from one place to another or by confining the person. Restraint is "without consent" if it is accomplished by:

(A) force, intimidation, or deception; or

(B) any means, including acquiescence of the victim, if:

(i) the victim is a child who is less than 14 years of age or an incompetent person and the parent, guardian, or person or institution acting in loco parentis has not acquiesced in the movement or confinement; or

(ii) the victim is a child who is 14 years of age or older and younger than 17 years of age, the victim is taken outside of the state and outside a 120-mile radius from the victim's residence, and the parent, guardian, or person or institution acting in loco parentis has not acquiesced in the movement.

It's clearly restraint under the statute. BTW, Bexer County DA Joe Gonzales is a Democrat.
