Hunter Biden indicted on federal gun charges

I honestly don't see Joe pardoning Hunter on gun charges.

I *can* see him pardoning Hunter on tax charges before it goes to trial, just to keep the truth buried. No trial = no public exposure. Of course, it will depend on what the specific charges are, and what they cover.

If Biden had a chance to win the election, I could easily seem him not pardoning his son. A pardon will be his one last selfish act, hoping everyone will move on and leave his son and his family alone after he transitions out of office. However, he might also extend that pardon to all of the other transgressions his son has committed too. Who knows? I don't see anyone significant continuing any effort after Biden is out of office as it really is nothing more than beating a dead horse.

Pardoning his son (chance or not at the presidency) will hurt the Democrats because it confirms everything we've been saying about the President's relationship with his son, his corrupted actions enabling his son and family members make a lot of money, and the exposure of all the lies he said in his quest to become President. On the other hand, there are a lot of Americans who are just plain ignorant, hate Trump or the GOP for no better reason than because their told they should, and those that simply don't care and will vote Democrat regardless of how it hurts them. The question is, are there enough to overcome a GOP candidate again? I would hope many have learned their lesson. I certainly hope Trump is not the nominee, but he is a big step up from the worst President this country has ever had. I would prefer we allow the next generation of Americans to run this country. I'm done with the Baby Boomers. They done their job, many served well, but it's time to retire them... All of them.

There is no law against having the name Casey. Barring guns from anyone based solely (or even partially) from having the name Casey is pretty obviously un-Constitutional. Yet I am still required to put my name on the form and can - and likely, WILL - be charged for lying about my name. It is also clearly NOT un-Constitutional to ask my first name, despite the fact that my first name cannot be used as a discriminator for gun ownership.

Lying on the form is a crime, irrespective of whether telling the truth would alter outcomes.

PO1 Jeff Chandler - I would have to say yes based on the SCOTUS decision regarding this nation's historical tradition of firearm regulation. It's even more concerning as there is now a basis to do away with ATF form 4473 and background checks as they may not meet the new test that SCOTUS added with their decision. In the New York State Rifle & Pistol Association v. Bruen, the Court announced a new test for assessing firearms laws, saying restrictions must be "consistent with this nation's historical tradition of firearm regulation." So where does one draw the line between our Historical tradition and recent history.

Now here is another wrinkle to consider. The law was considered unconstitutional by the 5th circuit and only applies within the 5th circuit boundaries. One can possibly expect an appeal to the SCOTUS. What if there is no appeal? What if there is an appeal and the court refuses to take it up.

I can say this. Its going to be very interesting how the courts deal with the New York State Rifle & Pistol Association v. Bruen SCOTUS decision. Oh they have another case this October that may give you an idea on where the Court is going.

PO1 Jeff Chandler - I was thinking the same thing. This new test on firearm laws is a whole new country where no lawyer or court has walked. Its going to take a lot of cases and time to bring real definition to this new test.
