3.) WHAT THE ARMED FORCES CAN, CAN’T, AND MIGHT DO AT THE BORDER
Ryan Burke | 11.20.18

Defense Support of Civil Authorities (DSCA)
In response to requests from civil authorities, the armed forces can support state and local governments in accordance with law and DoD policy. Military operations under DSCA must be formally approved in most cases before the military can intervene. However, DoD can provide immediate support during no-notice or limited-notice incidents in order to “save lives, prevent human suffering, or mitigate great property damage.” Other operational requests such as support to special security events require formal approval processes but still fall under the DSCA purview (for more on defense support of special events, see DoD Instruction 3025.20). Military forces providing DSCA often interact with law enforcement, especially during incident response or high-profile security events. Given the sensitive nature of military involvement in law enforcement domestically, DoD Instruction 3025.21—in conjunction with Chapter 15 of Title 10 USC—establishes the guidance for what the armed forces can do in support of civilian law enforcement.

BONUS :

What Did the Founders Mean by "Invasion"?

Regardless of one’s personal disposition on immigration and military policy, the founders’ understanding of “invasion” did not pertain to mere travel or immigration from one country to another.

On the contrary, the most prominent English dictionary available, the most widely adopted legal dictionary in the American states, and other popular dictionaries of the era all held the term to mean the projection of a physical attack.

Consequently, the ability militarize United States borders to stop peaceful migration is not expressly granted through the originally ratified version of the Constitution.

A GREAT deal of United States of American Citizens have NO TRUE UNDERSTANDING of the form of government they have.

You took the pledge of allegiance … to what (nationalism).

You swore an oath but did not KNOW what your oath is for.

* You wave your flags
* Shout your, Don’t tread on me slogans.

Most people are irresponsible with government because they are misinformed and never read FACTS.

When I took my oaths of enlistment/ enlightenment I knew beforehand what form’s of government I was willing to defend.

Federal Constitutional Republic

A government formed to keep legit check and balances by the PEOPLE to forever prevent a KING/RULER/DICTATOR/TYRANT/MONARCHY from ever being established as a form of government.

1.) United States is a federal constitutional republic

* JUNI 3, 2020

The United States is a federal constitutional republic, in which the President of the United States (the head of state and head of government), Congress, and judiciary share powers reserved to the national government, and the federal government shares sovereignty with the state governments.

There are major differences between the political system of the United States and that of most other developed democracies. These include increased power of the upper house of the legislature, a wider scope of power held by the Supreme Court, the separation of powers between the legislature and the executive, and the dominance of only two main parties. The United States is one of the world’s developed democracies where third parties have the least political influence.

The federal entity created by the U.S. Constitution is the dominant feature of the American governmental system. However, most residents are also subject to a state government, and also subject to various units of local government. The latter can include counties, municipalities, and special districts.

MAJ Montgomery Granger - First, you are misreading the Constitution and the Invasion Clause therein. "In order for a state to be afforded the protections of the Invasion Clause, it must be exposed to armed hostility from another political entity, such as another state or foreign country that is intending to overthrow the state's government." Padavan v. U.S., 82 F.3d 23 (2nd Cir. 1996) (citing James Madison, "Federalist Papers, No. 43"); see also California v. U.S., 104 F.3d 1086 (9th Cir. 1997); State of N.J. v. U.S., 91 F.3d 463 (3rd Cir. 1996); and Chiles v. U.S., 69 F.3d 1094 (11th Cir. 1995) (as governor of Florida), and so on.

Second, SCOTUS is the head of the judicial branch, and your oath requires you to support their decisions.

But we may not follow unlawful orders. Who decides that? I am not misreading the Constitution, you are parsing it. If that were to be letter for letter, then terrorists and drug cartels have carte blanche. If there is a perceived and/or real existential threat, reasonable people may act to protect themselves, and then hope they don't get a lawyer like you to defend them when Sleepy Joe & Co. come for your rights and then throw you in a DC jail indefinitely, loosely accused of "insurrection," but never indicted or prosecuted for such.

MAJ Montgomery Granger - Try reading the cases I cited. All of them are in agreement, and all cite Federalist #43 by Madison. The current SCOTUS is made up of textualists and originalists. It's not an invasions, nor are crossings by drug cartels or illegal immigrants an "invasion" according to the courts. This has nothing to do with parsing the original text of the Constitution, it has to do with me explaining to you exactly what the word invasion means in the law.

This has nothing to do with the right of individuals to defend themselves against criminals or attacks against them. Illegal immigration, by itself, doesn't rise to that level. Further, the states may not step into the immigration regulation area, that area belongs exclusively to the federal government, see Arizona v. United States, 567 U.S. 387 (2012).
