Sure, we suspected this would happen, but other states with versions of an AWB tried to get California to NOT appeal the decision and just take their licks. If this does go to the 9th Circuit, the outcome is less certain now than it would have been before the appointments to that court made during the last administration. As it stands now, the makeup of that court means California is much more likely to lose on this appeal. If that happens, states like Oregon and Washington, both strongly anti-gun governments, would also be covered by Judge Benitez' decision which now only affects California. Regardless of how the 9th Circuit rules if they do appeal, it's very likely this will go to the SCOTUS, which is why states like New York want this to end soonest. When that happens and if they decide to hear the case, it is almost certain that the original decision will be upheld and AWBs will be ended across the country.
