Although He may have violated some rules given what is here there seems there are no witnesses that confirm it was even a rape including the alleged victim. To proceed with a court martial for that charge with what appears to be a lack of evidence and witnesses saying it wasn't a rape. They have Him hung out to dry without any evidence to support their prosecution from the appearance here. Many time it seems that prosecutors are too quick to pursue thing more on what they think others perception is than the merit or lack of merit of a case. The cadet may have used poor judgement but that isn't a criminal act absent any evidence to the contrary. if there had been evidence a crime was committed I'd have no sympathy for Him but that doesn't appear to be the case. Myself with over 40 years civilian and Military Law Enforcement background in both State and Federal proceeding It's My opinion based on what is stated here the prosecutor stepped way over the line and this may well border on a malicious prosecution, time will tell.

Give that man a harumph. Right on target especially since the alleged victim didn't state it was rape. However, Prosecutors don't bring or prefer charges in the UCMJ only commanders on G series orders can do so. Prosecutors only recommend to commanders. Now there are some commanders that want to make a name for themselves and with the climate at the academy I can see where they would want to press...however, this would get thrown out especially if the victim says it was consensual/. IMHO.
