The Fifth Amendment, alongside the Fourteenth Amendment, both speak to “due process”. Due process refers to a person’s right to fair treatment, and to be given adequate procedural process by the government. According to the Fifth Amendment, no one shall be “deprived of life, liberty, or property without due process of law.”
In support of the due process clauses, the Sixth Amendment guarantees the right to a speedy trial. Someone who has been charged with a crime shall not be held for an unjust amount of time, as this would be depriving a person (who could possibly be innocent) of their life, liberty, or property.
The Ninth Amendment states "The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people."
In my opinion this guy, and anyone else affected by red flag laws who is innocent have a major case against the state government(s).

Yeah, this is going to happen whenever we have something where we identify people we think may pose a threat. No fly lists, red flag laws, even sex offender registries, they all have the same problems.
The longer this problem with gun violence remains a major issue, the more of a case the government has for a compelling state interest to put limits on the 2A. If we want to keep our guns we've got to find a way to stop gun violence, particularly mass shootings.
