The Law Needs to Change for Overbooking and Bumping
As the United Express Flight 3411 incident clearly demonstrates, laws regarding airline passengers need to be improved. The compensation that United offered its passengers on that flight was perhaps too low. Dr. Dao said he wouldn’t get off because he needed to be in Louisville to treat patients in the morning. Even when an airline raises the monetary incentive, there will always be passengers who do not desire to be bumped.
You have to make an offer that sufficiently motivates a passenger. The incident involving Dr. Dao makes it appear that an airline can offer one compensation amount and if the passenger declines, the police can forcibly remove that passenger from the airplane. This is not a story that inspires customer loyalty or creates a good customer service image. Legally, the airline can offer any amount. The law sets minimums, not maximums.

If the airline doesn't rebook you or books you on another flight that gets in to your domestic destination two hours after your original arrival time (four hours for international destinations), you are entitled to 400% of your one-way fare, up to $1,300.
