No worries. Unlawful combatant Islamists who want to kill us, held at the US military detention facility at Guantanamo Bay, Cuba, "may be held without charge or trial," just like lawful combatant POWs, "until the end of hostilities," according to the Geneva Conventions and Law of War. That said, several law suits have been brought and a few won, challenging a detainee's right to habeas corpus. Currently, they have a right to petition the US gov't for habeas, but so far only a few have received that right. Most (740+) detainees have been RELEASED from Gitmo, and NONE have been beheaded, executed, blown up, hacked to death, dragged naked and lifeless through the streets, drowned or burned alive. All things our enemies have done to US and/or our allies. In fact, there is no moral comparison between Gitmo and how our enemies treat their captives.

Sgt (Join to see) - The Constitution applies to anyone on US soil - citizen or not. Pretty much the only thing that is afforded to citizens only is the right to vote...but even then that gets stripped from people convicted of felonies.

MAJ Montgomery Granger - We are not in a state of war! Have not been since 1945. Those people being held at Gitmo should be tried, and if convicted, sentenced to the appropriate place. If found not guilty, they must be released. In the case of Khalid Sheikh Mohammed, he was already guilty by a military tribunal. Send him to Florance. He can be a cellmate with Abu Hamza al-Masri.
