He is pleading guilty because he wants his day in court which will further highlight the failure in command to execute the mission correctly, he will make all sorts of money on the talking circuit. I think he will do OK, there is a chance that everything will be dropped and they will just boot him to minimize the exposure he will get in a court martial. IANAL so nothing I said is gospel nor do I have aline to all the facts. Either way the Marines will look bad just like the Army with the other goat Phucks that went on during the evacuation.

PO2 (Join to see) I think at this point all the Corps wants to do it make an example out of this. The Colonel resigned his commission and lost his retirement he could have started collecting in just a couple years. He is already out, what are they going to do? Give him a Bad Conduct Discharge to put icing on the cake or what.

Cpl Vic Burk He’s not out. His resignation has to be accepted in order for him to resign. That apparently didn’t happen.

CW4 Guy Butler - I see. I thought when you resigned your commission that was the end of your time. Learn something new every day Chief. I still think they are just trying to make a example of him because he exposed what they didn't want him to. The question is, who is going to be the jury on the courts martial? Officers that are senior to him? General pool of officers? Enlisted? I would be most interested to know the answer to that question.

Cpl Vic Burk It may just be just the judge, especially since he pled guilty. There’s no mandatory board requirement in a special court martial.

If there is, qualifications are as follows:

“ Qualifications. The members detailed to a court-martial shall be those persons who in the opinion of the convening authority are best qualified for the duty by reason of their age, education, training, experience, length of service, and judicial temperament. Each member shall be on active duty with the armed forces and shall be:
(A) A commissioned officer;
(B) A warrant officer, except when the accused is a commissioned officer; or
(C) An enlisted person, except when the accused is either a commissioned or warrant officer.”
