Written consent in front of lawyers and the whole event will be recorded. Audio and video with no less than three of each recorder types. All recordings must be Archived for no less than one year by both parties and Lawyers present.

....Talk about a screwed up law. I would like to go back in time and hear the debate on how this even came to be. Truly Neanderthal thought process.

Obviously, rape laws and incidents are very legally complicated matters. The crimes almost never happen around witnesses (he said/she said) and unlike other crimes there is no body or stolen property, typically just an accusation and forensic evidence that frequently can suggest a consensual act as easily as a non consensual one.
So while the law seems very dumb, I think at it's heart it's more complicated than that. Yes-means-yes (affirmative consent laws) are starting to spring up in a few states and as policy at some universities and they seem equally obtuse for they require the initiating party to get verbal permission, sometimes throughout the encounter. In practical terms, this puts the accused in the peculiar situation of proving his innocence, that he (usually) did indeed seek permission before proceeding, in effect turning the justice system on its head.
Of course, in any situation, the hard part is proving it. How does one prove that a woman told a man no (or vice versa, that he got her consent)? It's very difficult, as it should be.
