It look like they think Cohen is guilty, otherwise even discussing a pardon would be senseless.

Cpl Tom Surdi - It was built into the system from the start , other wise sovereign entities would not be sovereign, the exception is exactly as old as the ban on double jeopardy is. Do you feel people being charged under both local laws and the UCMJ is shady also?

Capt Gregory Prickett - I think in the King case the Federal charges were significantly different than the state charges.

What the idea of Trump possibly issuing a pardon prior to a trial, or hinting that he would pardon Cohen if found guilty in trial, is to try and prevent Cohen from flipping on Trump and convincing Cohen to turn down any plea deals that could lead to exposure of Trump. It's like saying "keep your mouth shut, and even if you get convicted, I'll get you out of it completely with a pardon".

So of course Trump won't come out and say that directly, but attempt to signal it through backchannels and vague actions, like suddenly pardoning Scooter Libby out of the blue.

I hope he does tomorrow. Then, Cohen would have to answer any and all questions from the investigators, he would not be able to take the 5th.
