The attacker fled, It was let him go or shoot him. He made the right call IMO

Very few states OK shooting a fleeing perp in the back. Most say you must be in imminent danger and fear for your life. Time to notify Law Enforcement and let them do their thing. However, that being said, the handgun could have been used as a blunt weapon and knocked the SOB along side the head.
