Funny how that works.
Even funnier is how the right (and Scalia himself) held up Scalia as a strict textualist, as in one who limits interpretation of the constitution to what is in the actual text, when that same Justice Scalia created all sorts of legal fiction in Citizens United (corporations as people and money as speech) and Heller (not just ignoring, but saying the "well-regulated militia" language of the second amendment is obsolete).

Personally I think sitting justices should refrain from discourse outside their courtroom. I think Ginsburg should have refrained from her comments and Scalia should have refrained from his repeated conversations about his beliefs. Criticizing her or calling for her to resign is completely ridiculous if you were ok with Scalia though.
The Supreme Court should be the pinnacle of the justice system and those bringing cases before them should be sure that they will decide the case on it's merits and legal precedent, not their own beliefs.
