I cringe at the misuse of the "overstaying a visa" term. One can be here on an expired visa and be totally legal, and others can be here on a valid unexpired visa that is good for another 9 plus years, and be here unlawfully. If someone is going to make statements, they should know what they are talking about. The correct term is "non-immigrant overstay" as some people did not even use a visa to enter the US, therefore they can't be a visa overstay because they never had a visa. We simply call them "overstays", and really don't even look at the visa or lack of a visa or how they entered; we look at long they were given for their temporary time. Sometimes it is a week, sometimes a month, sometimes 6 months, sometimes several years, it doesn't really matter, they are an overstay, but has nothing to do with their visa. The headline alone is misleading as it cites "undocumented immigrants" because if you enter legally, you are not undocumented. If you wanted to get really technical, you would have to establish which ones that came legally as a non-immigrant, and then decided to stay permanently, which would make them an immigrant, but not documented as an immigrant; as opposed to the ones that came temporarily and overstayed their authorized allotted time just because they were having such a good time and they just haven't left yet for some reason. All in all, most of the ones that commit the most crime came here illegally from the get go. Yes, it would be nice to get a better hold on all this, but the most important ones are the ones committing the most crime.
