Asked if he drank alcohol, he said, "No, not really, other than at lunch. I don't know what they had there. It was not anything excessive. I think I had a beer, that was it". Lets see here....a lawyer told him to refuse the DUI test, but you refused to keep your mouth shut? I'm sure there is a cop laughing his ass off at this. "I've got bad knees, and I can't walk very good (no crap really?)...I did not agree to the DUI (test) because every lawyer I've ever heard told me not to do that, everybody I know and trust who's worth their salt as a lawyer". Your lawyer buddies suck. They should all be disbarred and kicked in the tail on the way out the door. I guess he forgot there is a camera usually rolling and a second person on scene to monitor the sobriety check and to ensure the legal standard is met.

THIS should be on this weekends safety brief when it comes to drinking and driving.

Capt Gregory Prickett Where I was living, once you refuse to do it FST/Blood, your lisence is suspended right there. He did the FST. If you can do that, you should just continue on with your punishment. Refuse all, or do all. Giving it a ‘halfassed’ atttempt then realizing you screwed up only makes you(him NOT you) stupid. He told them when asked if he had been drinking yes. Well you don’t go back and try to quantity it without proof of your own, and his ‘reasoning’ is horrible.
If an attorney is giving incomplete or inadequate service they should be disbarred. Now when I said that I did mean it, but it was also failed sarcasm. When we did FST’s the second or more MP’s there were to ensure the FST was performed in accordance to state law, unit SOP, and it was something you would attest to on your statements. You’d even go to court if required where those very statements are questioned. I cannot speak on where you are or what is it is not done by the police there. I’m not familiar with their specific rules, laws, or SOPs.
