That's true imo. Sometimes the JAG is much more anxious to file article 15s or for courtsmartial than the commander is.

They’re lawyers. It’s what they do. Most I’m not too impressed with as I think they became lawyers for all the wrong rea$on$, but I knew a few good ones.

One was a prosecutor that had an alleged rape case involving two Marines that in reality was consensual BUT the accuser was married and the Marines knew it. The prosecutor could have opened up the case wider and pressed hard for convictions but he would have screwed a few Marine enlisted in the process and was advised by the CO against it. It would have opened a can of worms that nobody was prepared to deal with.

As I mentioned the accuser was married and she came on to the Marines. She was known to the Marines at the barracks as the “Base Mattress.” She only came out with the rape allegations when her husband asked her what happened to her back and she couldn’t explain away the carpet burns and her infidelity so instead she accused the two Marines she had sex with and said they raped her.

The accuser had previously had sex with other Marines in the barracks and they came forward in defense of the accused stating they had previously had sex with her (which was stupid because they could have been NJP’d for having sex with a woman they knew was married). The prosecutor told them to be quiet and say no more about it. He never called them as witnesses nor did he charge them but technically he could have.

As soon as she got on the witness stand and opened her mouth her story fell apart and it was over. As a prosecutor he he knew he was going to lose the case by putting her on the witness stand but did it anyway because it was the right thing to do.

Both sides (the accused and their accuser) should have exercised better judgment. The sex was consensual and it was not a case of rape as she alleged.

The Marines weren’t convicted and didn’t lose their careers but they were still tainted by their poor judgment. I don’t know if they were ever promoted again but I suspect that if they were otherwise stellar in their performance they would overcome their mistake.

As for the accuser, she and her husband were transferred to another base and ordered to get marriage counseling.

Had the prosecutor only been interested in getting convictions, he could have gotten convictions on not just the two accused but all the Marines that claimed they had sex with her because she was married and they all knew it. Every one of them could have been booted out of the service but cool heads prevailed and given her reputation and her false accusations, he decided it wasn’t something worth ruining their lives over. Hopefully the Marines that were involved with her learned a valuable lesson from both their impulsive actions and the mercy shown by the prosecutor.
