Of all the issues that face America today, it would be interesting to know how this one rose to the top of the attention of the Supreme Bunch. For me, it's an evidentiary matter (and SCOTUS is supposed to focus on Constitutional matters). Either they did or they didn't and that's the purview of the court of original jurisdiction.
