This is a good example in the differences in ROE's and protections under SOFA's between GI and contractors. One of my many reasons for not liking the heavy use of contractors - they are more exposed to legal risks not just in country but conus as well.

I really doubt the retrial will go any better for him. However just the fact that his motion for separate trial was denied then reviewed to find that he should have been given the opportunity bodes well for the system at least making some effort to follow the rules.
