SCOTUS should punt, on jurisdictional grounds. The art is in Germany, owned by a state entity, allegedly sold by Germans to other Germans, and so on. It belongs in a German court.
For those who disagree, how would you feel if the Bundesgerichtshof (Germany's highest court) ordered the Smithsonian to turn the von Braun exhibits over to the Deutsches Museum on the grounds that von Braun was "coerced" to work for the United States after World War II?
