Rules are meant to be followed and, not forgotten. When the Rules stipulate that vessels crossing on your starboard side must be allowed to pass first then, there is no ambiguity in the Rules. CDR and his XO of the Fitzgerald are responsible for this mishap. Other officers on the bridge and below are accomplices for not raising the alarm and warning the Captain and/or the XO. Investigators will clarify chargeable accomplices.
