To be honest, this was pretty commonplace in history. It wasn't truly designated as a war crime till 1899. Previously, as far as we know there were only 2 real trials for this prior to 1899. Some Holy Roman knight named Von Hagenback got beheaded in 1474, though it was termed for 'Conduct unbecoming a Knight', and good old confederate officer Wirz from Andersonville Prison in 1865.
