I Think I Found A Qmp Flaw. If A SSG Gets A Fg Article 15 And Reduced To SGT, Once Promoted Back To SSG He Won't Be QMP'd.

I was thinking about this today. Once the NCO get's promoted back to SSG he is not eligible for the SFC board because of time in grade and his record won't go before the board.
Or if he doesn't get promoted back to SSG for a while he can just hide out as a SGT until RCP
Is this a good thing or a bad thing?

If a SSG receives a field grade article 15 and is reduced to SGT, that newly demoted SGT should probably be processed for separation.

Things are always changing...that's why we share information.

Because commanders are not utilizing their separation authority, HRC has tools in place that notifies Career Counselors of reduced Soldiers...whether they are passed RCP or not, HRC can update their ETS and they'll be out within 6-9 months.

SGM, If a SSG received an Art 15 back in 2006 and was demoted but stayed in the Army and made SSG back in 2012 Will that NCO QMP'd?

SSG (Join to see) According to the current "rules", the Art 15 in the restricted OMPF wouldn't be considered since it was not current "in-grade" misconduct, but the board could consider a derogatory NCOER that resulted from the Art 15. Just all depends how far back the panel decides they want to go.

Our command just recently had this exact situation - a non-Indef SSG with Field Grade misconduct.

I understand QMP the same way you do - only "in-grade" misconduct will be considered for QMP.

Since I and this SSGs chain thought that he could recover and was worth it, we opted to reduce him to SGT to keep him from being identified for QMP. This will allow him to re-fit, attend a SSG promotion board (if deserving) and climb his way back up. Also, the time it takes to make it back to SSG should nullify the last 5 NCOERs that will get looked at when they are considered for SFC.

On another note, the "reduced-in-grade causing RCP violation" is a great tool also. If you reduce someone and it causes them to violate their RCP, they have 90-180 days until ETS. An Admin Reduction Board for an NCO could be a more efficient route than a chapter.

Lot's of changes to regulations dealing with retention - it would behoove us all to learn the ins and outs to ensure that we apply the right tools at the right time to get the desired effect.

Sounds like SGM Matthew Quick needs to give a class.

But RCP gets them based on active federal service years, see Army Directive 2013-28 (Retention Control Points).

RCP for Sergeant and Sergeant(P) is 14 years. So a SSG at 15 yrs of AFS is reduced to SGT must retire or separate no earlier than 90 days or no
later than 180 days after the effective date of the reduction in grade. They have exceeded their RCP for their grade.

Not if that SSG was INDEF before he was reduced. Then his RCP does not matter because of his contract. Most SSG's at 15 years are INDEF. It would be hard not to be.

If you are reduced and INDEF you are allowed to serve to 20 years; not your RCP.

The RCP does matter...the ALARACT (para 5) covers this:

"5. Soldiers serving on an indefinite reenlistment, who are reduced in grade or removed from a centralized promotion list and who exceed their RCP as the result of a reduction in grade or removal from a centralized promotion list after 31 January 2014 will be separated not earlier than 90 days or no later than 180 days after the effective date of the reduction in grade or removal from a centralized promotion list."
