It absolutely is Freedom of Speech. It's also Inciting a Riot.

The second she said "I’m plotting now.” it became a viable threat, and went from Protected Speech, to Speech that crosses a line (the old Fire in a Theater argument).

Just because you can say something, doesn't mean you should say something.

Inciting a Riot, or Fighting Words are not Protected. You can be stopped for saying it.

Freedom of, is not Freedom from Consequence, as Ebony Dickens a.k.a. Tiffany Milan discovered when they slapped the cuffs on her.

I don't believe in inciting riots, which suggests that one person is responsible for other persons' actions. I'm plotting now, however, means that she is making a viable threat, which should, at least, be investigated.

In common law, assault is the act of creating apprehension of an imminent harmful or offensive contact with a person.

Sounds like Assault to me.
