Okay! Finally found it!
The retired service member does qualify for this award. How one goes about putting him in for it I do not know.

I was army so I looked up my services regulation. So, AR 600-8-22, Sect. 3-3, Personnel Eligability, this section actually does not have anything that specifically pertains to retired service members. It does state that certain awards may be given to civilians if signed off by the Secretary of the Army, however these awards are for civilians serving in a combat zone.

I do believe that there are civilian awards that can be issued in this case. I will look them up and get that info to you.

He could be given a civilian award, but not the Soldier's medal, because he was not on active duty when this happened. And I doubt they would retroactively recall him posthumously for this....
