Can the VA refuse to treat a 100% service-connected veteran citing their case as "too complex," and also refuse to outsource them for care?

I have a pretty 'complicated' medical case but the VA continues to refuse at times to even consult with me despite internal VA referrals for the consults. They also refuse to refer me to anyone who possibly CAN help-- or the Mission Act options don't have any providers for the care needed within hours of me. Then they refuse to cover many of the meds that outside specialists suggest, costing me >$3,000 per year out-of-pocket. Is this OK at any level and would anyone have any suggestions for how to get the needed care? This way preceeded COVID-19 issues but continues despite it. I've been told the doctors won't even agree to a telehealth or video health consult at the VA across a few departments and programs. I'd already involved a senator's office a few years back and have made almost no progress. Help, please?

I’d ask for a referral to a VA that does offer that surgery, with 100+ hospitals they do it somewhere if not local if your 100% it shouldn’t be a problem. I live I. upstate NY and had a friend who needed spinal surgery and he went to Bronx VA for it

The VA can, and has, refuse to treat or acknowledge anything they so choose.
I got out 23+ yrs ago with a disability rating, service connected, and the VA refused to pay me for 5 yrs. My attorney sent in request after request, citing the VA's own processes and procedures, and they refused. Finally, a retired Coast Guard CWO-4 at TROA heard about my situation and wrote the VA rep a "personal" note, threatening to go to the local news station. I had my money in under 30 days.

Facility Patient Advocate or Patient Experience Office should be your first step to get a multidisciplinary team formed around your Patient Aligned Care Team. If that fails, you can reach out to White House VA Hotline: [login to see] to initiate a case vice sending a letter to POTUS.

I know a VA attorney who works these issues all the time i sent you a request with cell phone please reach me and ill get you in contact with him to help you resolve this he has helped me and many others in my unit with VA issues

Contact your congressman and file a complaint, or better yet, contact the White House VA complaint line.

Don't give up. Put your foot in the door and leave it until you can sell them on helping you.
If you deserve it you will get it.
Many times it is hoped someone will just quit.

I also would look at your 100% determine if disability or unemploy ability.
If you have a service represenative ( DAV, ARC, VFW,OR AMERICAN LEGION) go to them for assistance. I would suggest DAV. I would contact your House Congressional represenative and or your two ( 2) senators and the President, and get a lawyer.
I did not get past the DAV and they did an outstanding job assisting my case.
As a point there is no difference in this battle as in any battle you want to use the resources you need and be in for the fight.
