Can the VA refuse to treat a 100% service-connected veteran citing their case as "too complex," and also refuse to outsource them for care?

I have a pretty 'complicated' medical case but the VA continues to refuse at times to even consult with me despite internal VA referrals for the consults. They also refuse to refer me to anyone who possibly CAN help-- or the Mission Act options don't have any providers for the care needed within hours of me. Then they refuse to cover many of the meds that outside specialists suggest, costing me >$3,000 per year out-of-pocket. Is this OK at any level and would anyone have any suggestions for how to get the needed care? This way preceeded COVID-19 issues but continues despite it. I've been told the doctors won't even agree to a telehealth or video health consult at the VA across a few departments and programs. I'd already involved a senator's office a few years back and have made almost no progress. Help, please?

This has happened before. And it takes a simple lawyer to contact the Va & it will be handled quickly. They have lost too many cases to try to pull this over & over & over again.

File a complaint with the OIG office. That should fix it. VA website will tell you how to file the complaint

What they do is they say that you’re not that bad. You need to get your records and see exactly what they are reporting. I imagine that what you are told is not in your records. If it isn’t then tell them all correspondence needs to be done in written instructions. Now these meds yes the VA can provide them. The how is a bit harder. The doctor has to put in a request and explain why that med is needed. I would expect it is because it would contradict what they have been saying in writing. My experience comes from having Hoshimotos Thyritis. Which after being treated for the endocrinologist at the VA said that they did even think I had. Easy test it’s a blood draw for the antibodies. Said no to the test because there is no diagnostic value. So to cover up incompetence they just just refuse to do the test. By the way this is what I am rated at 100%. I am missing cartalidge behind my knee caps and have bone spurs now on the front of the joint and the knee cap itself. I was told I was too young for knee replacement and denied pain management. I was told I was a tough guy and it didn’t hurt that much. So I understand your pain. To get the senators on your side your going to need to refute what they are writing into your medical records so first you need to get an account and use the blue button to get them or do a freedom information request. I also imagine they will want you to have seen patient advocacy but they tend to try to protect the VA and not the patient. Well that’s my advice and some back ground use it how you will and good luck

Ive stopped using the VA for just that reason. I was a 90270. A few suggestions. If you retired from service make sure you have tricare. Next apply for social security disablity since you are 100% through the VA. If you get approved for that then you will get medicare. Now you have medicare as your primary health insurance and Tricare as you secondary. Then use a civilian doctor and you have no copay for visits and most procedures. Your medication is through tricares express script and you pay a copay for the meds. Usually $12 to $40 per prescription. I have to have nerves in my back burned about every 6 mos and the cost is around $4000.00 and I dont pay anything for that treatment.

Write a letter to your Congressman, at all levels. As SPC Richard Zacke says, the WH, and that staff, and yes it can and will be covered, most likely. I had a double lung transplant 20 years after separation from service and the name brand meds that are recommended from Duke are getting the pushed down to the basic meds that VA is willing to pay for NOT what DUH is wanting their transplant patients to take. Talk to your Representatives, Senators, and all the other ilk on the Hill to get the Health Care PROMISED/Contracted to you and me.

I agree, if your senator was no help, write the POTUS & cc your states senators, particularly if they will be running for office soon. It seems as though once political interest is shown, nothing is to expensive or to complex.
