Yes - given probable cause he could have and would have done so through an appropriate FISA letter or warrant. All of the facts that have come out suggest there would have been probable cause for a Judge or FISA court to issue such a warrant.

However, both the unrestrained prejudice of the likes of McConnell and the comments in open fora such as this one clearly demonstrate that legality was less important (it would have been legal) than the turmoil it would have created if he had done so.

Remember that the Senate and House, McConnell and Ryan, both knew of FBI concerns and of potential business and financial irregularities that have since been adjudicated and found to have occurred. Trump charities are barred in NY.

For those here squawking about Obama being a liar, and Obama's "loyalists" - you do yourselves and your branch a dis-service by failing to maintain the understanding that your oath was to the COUNTRY and the CONSTITUTION. In psychology, what you are doing is called projection and there is too damned much of it in the media, in public discourse, and from this very shady regime. < That, by the way, is NOT my "opinion" but a valid judgement based on the number of convictions, pending cases, and current indictments. They have indeed set records. The wrong ones.

Whether he did, or didn't please, remember your oath is not to him but to the nation. Bad commanders have come and gone but the USA is still here. We are allowed our private opinion(s) but once you voice them you have set foot on a slippery slope. Yes, many will agree that he did. Many will say he didn't but as a member of the armed forces you need to keep private your opinions. Now that you have voiced/written your opinion you are now going to be viewed differently by your commanders and subordinates. I hope this does not offend any one but at the same time I urge caution until you are a private citizen.

Short answer. The President has the authority and if probable cause of espionage is brought to a FISA court they can issue a warrant. This would happen covertly.

I don't buy that trash about one President wire-tapping another presidential candidate; it is insane with all the checks and balances we have in place. Then; the other side of the coin is that if the Russians can mess with our elections then, anything is plausible. However, it is still very unlikely.

Unlikely has just been proven to have happened and shared with then Presidential candidate Donald Trump about his opponent (Hillary Clinton, who was the recipient of Trump's under-the-belt jabs in those elections that Clinton found it best to bow out that stomach such insults on public stage). The share was by a foreign intelligence collection and analysis wing of the Russian Intelligence Agency (KGB), which should have been found, fixed and finished prior to any compromise of confidential Party information, but slipped through the FBI, like 9/11 years ago (reliving this memory is to ignite bad recollections of that era for me). Putin and Trump are comrades, which is no secret at all; perhaps the two are business partners. The fact that Trump is untrustworthy and adversarial towards neighbors, and trade partners is not positive representation for the Nation. The Wall is a facade to hide an inability; the Wall will negatively impact the auto manufacturers in the Nation and the Nation at-large has spent countless hours on this nonsense. The Wall will never address the National Security issue, trust me. Meeting with Kim Jung Un was a waste of time and taxpayer dollars; the U.S. paid for Kim's stay in Singapore and Hanoi, but the outcome was "reciprocal denuclearization" or " lifting all sanctions against the DPRK". We have been there previously and heard these and more responses from Kim Jung Un and Kim Jung Il before. I believe this rhetoric has been repeated by North Korea since the era of it's founding fathers Kim Il Sung. We could have saved and avoided disappointment. China was a major national trade and investment partner of the U.S., American industry found it much cheaper to manufacture products in China and deliver much cheaper to APAC, MENA and parts of the former Soviet Socialist Republics east of Turkey and Syria, to include Kyrgyzstan, Uzbekistan, Turkmenistan, etc. With Trump's China new trade policy, U.S. firms are scouting afresh for new manufacturing bases in Asia, like India. It wasn't long before China retaliated and levied taxes on raw materials from the U.S. Trade with India, a priority partner, had also been impacted by Trump causing India to act likewise. Perhaps Canada has agreed to a revised trade agreement with the U.S., but that is because Trump is behaving like a Bully on the world stage and this is negative image for the U.S.

I repeat again, I am a neutral and non-voting citizen of the U.S. I believe that whosoever is elected POTUS is also the CinC of the Armed Forces, regardless of Party or politics. There have been 19 Republican presidents since Abe Lincoln and only 15 Democratic, and I have respected all 34 since I took the Oath in October 1990; it is hypocritical to vote for one and then serve under that candidate's opponent post the elections, I feel, so I stay neutral sharing facts following careful analysis of each situation.
