It is a slap in the face to all serving members.

That being said, the results of the court martial is not the final word. While I would have liked to see him removed from service, the only way a Court Martial can do this is with a bad conduct discharge. Upon returning to duty following his punishment phase, there should/will be a fitness for duty review that will see him removed from service with a discharge of somewhere between honorable and bad conduct.

As for the double standard... Affluenza attacks again...

Sir, I am hope you are right. I personally hope that we dont have to pay this guy a retirement check for the rest of his life.  Only those whose serve honorably deserve that distinction.

SSG Woodard, excellent post.  I for one am glad that you took the time to write/research that.  As the future of the Army, you now have insight to how important this topic is, and the true depth of the problem.  As you continue in your career, look for prevention versus reaction.  Prevent the problem as best you can by informing your subordinates of the same information that you brought to this forum.  You will be shocked that many will not know this.  "Yesterday's news is long forgotten".

Of course it upsets me, SGM. &nbsp;It would upset me to hear about ANY person convicted of sexual assault who got to keep their job in ANY profession. &nbsp;It's downright disgusting in all honesty, SGM, and goes against everything I thought the Army stood for.

Well spoken.  Dont let this sour your opinion of the Army.  We always get better and that is what really matters the most.  While it may be an outrage right now, in the future this will not happen, especially if we stand together and make sure it does not happen.

Don't worry, SGM.  I still recognize that like any organization, the Army has it's flaws, but that shouldn't deduct from the grand scheme of things.  Nevertheless, this is still outrageous.  We all know, SGM, that if it was me, a PFC, in that situation, I'd be tossed into the fire and made an example of.

You are most likely right about that.  Not just you, but all the Enlisted and the vast majority of the Officers.  Some people just have the ability to get over on the system.

I agree, SGM.  One thing I'm grateful my current CSM taught me in regards to a recent incident I was involved in is that I should have faith in, and trust the [Army] system.  There were many things that would have discouraged me or perhaps made me change my view on the Army, but his guidance helped me through it and by trusting the way the Army system operates,  I was able to be happy with the way things played out.  

This incident with this LTC is a clear example of how the system is flawed, and it's a big deal.  But one of the great things about it is it has a way of correcting itself, and I've learned my lesson which has taught me to not let the speed-bumps get the best of me.  I'm confident this LTC will be brought to justice properly, and if not, future cases will be treated differently.

I think what upsets me about this is the fact that obviously the person in question has zero integrity...and somehow thinks that they will not be noticed for staying in, while so many others are booted out on their fourth point of contact.

SGM, this is ridiculous, we all know if it was a junior enlisted Soldier he would be in Leavenworth right now and we let this guy off with basically a warning. We are headed in the wrong direction battling Sexual Assault when big Army basically says that its ok for a field grade to do this.

I know I would have when I was in commander called for the immediate separation of a Junior Enlisted for such a thing. However, I feel sick to my stomach as an officer to see this stuff knowing. By the way SPC (who also responded), officers are supposed to be held to a higher standard and can not leader effectively when their character is in doubt. Further more SPC, the concern here is at times in the case of enlisted, they have been treated guilty before evidence was ever reviewed.

Sir, we all know it is different spanks for different ranks. It is one of the reasons I am ETSing. Rule of Law not rule of good o'le boys is a REQUIREMENT to have faith in the system. It is also required in such a bi-polar, on/off, yes/no, black and white culture like the Martial culture.

Excellent post SGM, as I understood the reason we went to the SHARP program was to better police our ranks of things like this but to also show to our elected officials we took things like this serious. Obviously this is the type of ammunition our elected officials will continue to use to strip our commanders of UCMJ authority and ultimately in time will prove that we are not mature enough to punish anyone who commits these types of crimes. Seriously, how long would a soldier or NCO be on trial if they committed the same offense as that one star currently pending court martial.

1SG great point.  The Civilian leadership has already threatened to take away the power of our Officer Corp to deal with this problem.  This is only going to add fuel to the fire.  Imagine trying to bring a young specialist into a civilian court of law because he did not show up to formation.  At that point we might just as well become a civilian organization.

I read this article yesterday SGM.  We had a very lengthy discussion about it in my office.  Policies and standards should be fair and equal in both implementation and enforcement.  If there are allowed to be exceptions such as this, it makes continued enforcement at lower levels that much more difficult.  I hope that sometime in the very near future, someone from echelons above reality addresses this case publicly.  I believe that only with full disclosure and transparency will we be able to continue to enforce this policy with a clear conscious.

Respectfully, we have to ensure that every junior Soldier knows how to be their own advocate. I have been called in and the first thing I do is talk to the E-4's and below.


Unfortunately, due to OIF and OEF, the recruiters have lowered the standards. Many that have come in our ranks were not home grown. We have many SPC that are 35 years old.


We have SFC that have made the ranks in 8 years. This takes away from development. The change of the guard those that came in 1984 are retiring. This is significant due to we were mentored and developed by Vietnam Veterans.


Every generation in my family has served and it breaks my heart when I hear that Senior Leadership is not being held accountable.

Ma'am, I could not agree with you more.  All my early PSGs, 1SGs and CSMs were Vietnam Vets.  It took many years, and a whole lot of experience to get to the Senior NCO levels.  As one of the middle NCOs, one who it took a long time to reach those levels, but not as long as the Vietnam era Soldiers, it often sickens me at the lack of knowledge and leadership that some of our SFCs, 1SGs, MAJ, LTCs display today.  We have rushed many of these leaders to failure.

Amen SGM. My father was a 3 time Vietnam vet who wore a green beret. My perceptions on leadership and NCOship came from him, not the Army. I was spoiled in my first assignment by having leaders both commissioned and non who embodied those tenants. I haven't seen it sense and I am convinced it was a fluke for all those leaders of quality to be concentrated in one location.

When I look at the case of PFC Lavena Johnson, it is imperative that we educate our Junior Soldiers and as a Chaplain and having served thirty years in this Military it saddens me and shows me the work we still have a head of us.

Ma'am, thank you for your insight.  I agree we have to train our Soldiers for prevention.  Unfortunately, it seems as though it has taken us a long time to figure this out.  If we prevent, then we dont have to bear the reprecussions from the actions of a few individuals that have huge negative consequences.

When I came in
1984. I had a Vietnam Veteran SM who would take the E-4 and below and allow them to vent. He would take the regulations and show us how to be our own advocate.

When I was
an SPC, I had a 1LT come to me due to the COL tried to rape her. I
could
provide this 1LT with pictures from the Military Ball, and
she could give them to IG. I look back and this 1LT was the only female in her unit


I thank God I was able to help her, and the end result the COL was relieved. Dr. Johnson is PFC LaVena Johnson's Father and he had become an advocate for all of the female's that died, he wants to prove that the suicide was a cover up for murder.

This COL was relieved due to he had his hand on every female's knee. It is imperative that we train them to be their own advocate. We teach them how to write a Memorandum for
Record;
we teach them how to request an
open-door policy.

WOW!, that is totally unbelievable.  At a time when sexual assault and sexual harrasment is at an all time high in OUR military they let this LTC off with what amounts to a slap on the hand?  That defies logic and will only lead to Soldiers having the rightful opinion that the crime is not as serious as the individual's rank who commits the crime.  If this is not somehow dealt with correctly, the Army stands to lose an awful lot of credibility on it's war on sexual assualt amongst it's ranks.  Just my 2 cents.

SGM remember that the SHARP program is all about the victim and making sure they are taken care of.  I agree wholeheartedly that the way this case was handled was wrong but we cannot let it affect how we handle the training of our soldiers. I don't see this as a failure for SHARP but rather in leadership and accountability.

I just posted a discussion regarding this also.  It is very disturbing to know that there seems to be a double standard for Officers over Enlisted and Sexual Offenses.  Both Officers and Enlisted are supposed to live by the Army Values, so what makes this right and what makes it ok for this LTC to stay in the Army?
